The court has sentenced the former head of the Brovary State Administration for hitting four people in Brovary (video)
Vladimir Maibozhenko, the former chairman of the Brovary District State Administration, caused a traffic accident in Brovary in April last year while under the influence of alcohol, hitting four pedestrians at a crosswalk, including a two-year-old child.
The Brovary City District Court of Kyiv region has fined him 34,000 hryvnias and banned him from driving for three years, reports Brovarymedia.
Journalists report that according to the ruling announced by Judge Tatyana Vasylenko of the Brovary court, Maibozhenko must pay a fine of 34,000 UAH and 31,432 UAH in court costs. He will also be deprived of his right to drive for three years.
Additionally, the former head of the State Administration is to have his vehicle, a "Volvo," returned to him, which has been stored at a detention lot since the accident occurred.
The Kyiv regional prosecutor's office stated that they disagree with the ruling of the Brovary City District Court, which approved a reconciliation agreement between the former head of the Brovary State Administration and the victims, and they will insist on overturning the decision in the appellate court.
According to the prosecutor's office, the defendant's lawyer submitted a reconciliation agreement to the court, under which the parties agreed on a punishment using part 1 of Article 69 of the Criminal Code of Ukraine: imposing a more lenient penalty than provided by law.
"The prosecutor has submitted a written objection regarding the impossibility of concluding a reconciliation agreement in proceedings of this category, as well as the inconsistency of the provisions of the agreement with public interests and the requirements of the Criminal Code of Ukraine," the press service of the agency stated.
It was also reported that the court denied the prosecutor's request to examine the case materials that contradict the existence of mitigating circumstances.
"Due to the presence of circumstances that raise doubts about the impartiality of the court, a motion was filed to recuse the presiding judge, which was denied," the prosecutor's office noted.
On April 26, media reported that a drunk head of the State Administration ran over a crowd in the city of Brovary, Kyiv region. Four people were reported injured.
On the same day, the head of the Kyiv Regional Military Administration, Ruslan Kravchenko, announced that Vladimir Maibozhenko, the head of the Brovary District State Administration, would be dismissed from his position following the "horrific incident" in Brovary, which resulted in injuries to three adults and one child. The Office of the Attorney General of Ukraine reported that Maibozhenko had been detained and was awaiting a preventive measure.
Ruslan Kravchenko also clarified that among the victims of the traffic accident in Brovary was a mother with her two-year-old daughter. The child was diagnosed with a fractured humerus and a subcutaneous hematoma on the back of her head.
On the evening of April 26, the communications department of the Main Directorate of the National Police in Kyiv region reported the arrest of RGA Chairman Maibozhenko. A Drager test revealed 2.31 permille of alcohol in his blood, which is significantly above the legal limit.
On April 27, Maibozhenko was informed of the suspicion of violating traffic rules while under the influence of alcohol. He was placed in custody without the right to bail for two months.
On April 27, President of Ukraine Volodymyr Zelensky signed a decree dismissing Vladimir Maibozhenko from the position of head of the Brovary District Military Administration for running over people at the crosswalk.
